Tidal turbines in court

The court fight to stop two giant tidal power turbines from being installed in Minas Passage opened yesterday.

David Coles, lawyer for the The Bay of Fundy Inshore Fishermen’s Association, has applied for a stay on the installation of Cape Sharp’s two test turbines claiming they would do irreparabkle harm to marine life and fisheries in the Bay. He wants any testing delayed until February when there’ll be a full judicial review of the Environment Department’s approval.

Harvey Morrison, lawyer for Cape Sharp dismissed the importance of what he called a mythical baseline saying the whole point of the testing is to determine the impact of the turbines on the water to see if there’ll be any harm.
